People who had bought flights and flight inclusive holidays departing from the UK are protected by ATOL.
Important Note for Credit card payments
Section 75 of the Consumer Credit Act 1974 only protects passengers who paid by credit card if their payments were made directly to Tapestry Holidays Ltd.
The Civil Aviation Auguthority found that the vast majority of credit card payments were taken by a third party - Palegold Ltd, which also traded as Uncommercial Holidays. If your credit card statement shows that payment was taken by either of these companies you cannot claim a refund from your card issuer and should, instead, submit a refund claim through the ATOL scheme. The same applies to payments made through a travel agent.
Important note on finance agreements with Hitachi Finance
The CAA has learned that numerous passsngers have funded their Tapestry Holidays Ltd holidays by means of a finance agreement with Hitachi Finance. Such passengers are entitled to claim their initial deposit payment from Tapestry Holidays Ltd bond only. Payments made to Hitachi Finance should be reclaimed directly from them under Section 75 of the Consumer Credit Act 1974.
